Questioner: A woman lied that she has never had a marital affair with any man, but after marrying her it became evident that she had engaged in illegal sexual intercourse. What should her husband do?
Dr Sharof: It is left to the husband to decide whether to divorce her or not. He discovered that she lied that she has never had sexual intercourse before marrying him, and it became apparent that she lied. It is left to him to decide if he could tolerate her. Islaam does not frown at making reconciliation regarding this, but if you are baffled about it (there is no harm in divorcing her). If you fear that her sexual partners (in crime) could make jest of you regarding it, you can decide to do as you wish. It is left to you to decide whatever you want; the Sharee’ah cannot choose an option for you in this case. Na’am. It is better if you exercise patience regarding this issue. This is because it is very likely that she would never engage in such act again. Be considerate, and exercise patience with her especially if you don’t live with her in the same vicinity where she is known with such trait. It is blameworthy for women to engage in such acts because they will regret it whenever they’re exposed. Na’am.
